The Stakes Are High for the New Gambling Act

For five decades, Kenya’s betting industry has been governed by the Betting, Lotteries and Gaming Act. The law has been in place since 1966, and has remained largely unchanged despite being designed when the betting industry was a niche, nascent sector.

From just a few casinos and sweepstakes, the sector is now a behemoth that has joined the short list of Kenya’s lucrative but destructive vices. In a market now worth an estimated KSh 200 billion annually and employing tens of thousands directly and indirectly, the stakes could not be higher for the law’s first major overhaul, the Gambling Control Act, 2025.

The new law will replace the Betting Control and Licensing Board with a Gambling Regulatory Authority, a state corporation with the financial heft to keep the house and the punters in check. Its licensing model will also reflect modern realities such as online gambling, and carries a KSh 100mn security requirement for online operators.

Yet Kenya lags behind the best performers in data collection, verification, and accuracy.
